Please read these Terms of Service ("Terms") carefully before using the InsectAI mobile application (the "Service") operated by Nielogiczny Karol Labuda ("us", "we", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
InsectAI does not require user accounts. The Service can be used entirely without providing any personal identification or creating an account.
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and handle your data when you use our Service, including our use of analytics tools like OpenReplay. By using our Service, you agree to the collection and use of information in accordance with our Privacy Policy.
The Service and its original content (excluding any data you create and store on your device), features, and functionality are and will remain the exclusive property of Nielogiczny Karol Labuda and its licensors. The Service is protected by copyright, trademark, and other laws of Poland and foreign countries. Our trademarks may not be used in connection with any product or service without the prior written consent of Nielogiczny Karol Labuda.
Our Service allows you to create content, such as photos of insects for scanning ("User Content"). To perform the identification, this User Content is transmitted to our servers for processing.
By using the Service, you grant us a temporary, non-exclusive license to use, process, and analyze your User Content solely for the purpose of providing you with the identification service. We do not store your User Content on our servers after processing is complete. All scan history that you choose to save is stored locally on your device only. You retain any and all rights to your User Content.
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:
We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. Since all your data is stored locally, it will remain on your device unless you choose to uninstall the application.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. While we strive for accuracy, insect identification may not always be correct. Information regarding whether an insect is harmful is for informational purposes only and should not be considered expert advice. Nielogiczny Karol Labuda, nor its directors or employees, shall be liable for any damages arising from your use of or inability to use the service.
These Terms shall be governed and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will notify you of any changes by updating the "Last Updated" date of these Terms. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
